USE OF PROXY VOTES AT

BRANCH ANNUAL GENERAL AND SPECIAL GENERAL MEETINGS
 

PREAMBLE
 

Whereas section 5.15.4. states "A written power to exercise a proxy vote on behalf of any not present Branch delegate shall be allowed provided the proxy voter is present at the time.", it is acknowledged that circumstances might exist at the time of a Branch Annual General Meeting or Special General Meeting that prohibits members from being present to vote.


Whereas the principle of this policy would be to make it possible for members unable to be present at the Branch Annual General Meeting or Special General Meeting to vote at said Annual General Meeting or Special General Meeting, it should be regarded as the exception and not the rule. Determinations in the Constitution pertaining to quorums will not be affected by this policy.
 

POLICY
 

1. NTEU acknowledges that circumstances might exist at the time of a Branch Annual General Meeting or Special General Meeting that prohibits members from being present to vote. Such circumstances include:

  • illness of a member;

  • a member being unable to vote as a result of work commitments.

2. Under these circumstances alone a member will be allowed to mandate another member, on the prescribed form provided by the National Office, to vote on his/her behalf on:

  • a specific motion;

  • the election of office bearers.

3. Alternatively a member as identified above will vote in absentia, on the prescribed form provided by the National Office, on:

  • a specific motion;

  • the election of office bearers.

4. All proxy votes will be submitted to the electioneering officers / chairperson (whichever is applicable) before the commencement of the meeting.
 

PRINCIPLE
 

All proxy votes will be counted in the presence of the electioneering officers during the Annual General Meeting or Special General Meeting. No late submissions of proxy votes will be allowed.
 

DISPUTES
 

Disputes regarding the use of proxy votes during a branch Annual General Meeting or Special General Meeting will be referred to the President of NTEU for final adjudication.
